1. Introduction and Privacy Statement
Welcome to Contour. We are dedicated to the privacy and security of the students, parents, and educators who form our community. This Privacy Policy consolidates the data governance practices for our three operating brands: Contour Education, Contour MedPrep, and Contour TestPrep (collectively, "Contour," "we," "us," or "our").
By enrolling in a Program or accessing our services, you ("the Guardian" or "the Student" if over 18) agree to these terms. These terms constitute a binding legal agreement.
2. Master Services Agreement (Applies to All Brands)
2.1 Enrolment and Capacity
- Authority: By enrolling, you represent that you have the legal capacity to enter into this agreement. If the Student is under 18, a parent or legal guardian must complete the enrolment and accepts full responsibility for the Student’s compliance with these terms.
- Accurate Information: You must provide accurate and up-to-date contact, medical, and educational information. You agree to notify us immediately of any changes.
2.2 Payment, Overdue Accounts & Failed Payments
- Billing Cycle: All Program fees are billed in advance on a termly basis (unless otherwise specified in the Schedule).
- Payment Methods: We process payments via Stripe. By providing your payment details, you authorise us to charge the nominated card or bank account for all fees due.
- Direct Debit (BECS): Direct Debit is our default payment method. You must agree to the BECS Direct Debit Request Service Agreement (see Schedule D).
- Card Payments: Credit/Debit card payments may incur a processing fee passed on from our payment provider.
- No Cash: We do not accept cash or EFT payments.
- Failed Payments & Late Fees:
- If a payment fails, our provider will automatically retry the transaction every 48 hours (up to three times within five days).
- A $15 late payment fee will apply to each failed or overdue payment.
- If payment remains pending after five (5) days, the Student's access to the Contour Ecosystem (including the portal, recordings, and classes) will be automatically suspended until full payment is received.
- Chargebacks & Disputes:
- If a legitimate enrolment payment is disputed (chargeback initiated), all Contour services will be suspended immediately.
- Where a dispute is reversed in Contour’s favour, a $25 administration fee will be applied to cover bank processing costs.
- We reserve the right to terminate enrolment if a chargeback is found to have been made in bad faith.
2.3 Cancellations and Refunds
- Consumer Guarantees: Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).
- Major Failure: If we fail to provide the service as promised (e.g., we cancel the Program entirely), you are entitled to a refund for the unused portion.
- Change of Mind: We are not required to provide a refund if you simply change your mind, find the service cheaper elsewhere, or if the Student’s school schedule changes.
- Cancellation Procedure: To cancel an enrolment, you must email billing@contoureducation.com.au at least seven (7) days before your next scheduled billing date.
- Note: We do not accept cancellations via phone, SMS, or by telling a Team Member in class.
2.4 Intellectual Property
- Ownership: All program materials, including workbooks, booklets, lesson recordings, assessments, and online content, are the intellectual property of Contour.
- Prohibitions: You must not:
- Share, copy, or redistribute materials to any person not enrolled at Contour.
- Upload our materials to third-party sites (e.g., CourseHero, Chegg).
- Record lessons or share Contour resources with students not enrolled.
- Breach: Breach of these terms may result in suspension or termination of enrolment and/or legal action.
2.5 Code of Conduct & Responsibilities
- Student Responsibilities: Students must attend classes punctually and respectfully. They must engage actively with Team Members and maintain appropriate behaviour in all classes and online platforms.
- Guardian Responsibilities: Guardians are responsible for ensuring all fees are paid on time and that the Student complies with these terms.
- Termination: We reserve the right to terminate enrolment for serious breaches of behaviour.
2.6 Limitation of Liability
- Academic Disclaimer: Contour commits to providing tutoring services with reasonable care and skill. However, no guarantee of specific results or grades can be made; improvement depends on student effort, attendance, and engagement.
- Liability Cap: To the extent permitted by law, Contour is not liable for indirect or consequential losses. Our total liability is limited to the amount paid for the relevant term.
3. Schedule A – Contour Education (K-12 Tutoring)
Applies to students enrolled in K-12 tutoring programs.
A1. Attendance and Missed Classes
- Compulsory Attendance: Weekly attendance is compulsory for all enrolled students (except workshops).
- Rescheduling: If you are unable to attend a class, please contact hello@contoureducation.com.au in advance so we can assist with a reschedule where possible.
- Missed Classes: Where rescheduling is not possible, full recorded lessons and annotated workbooks will be made available through the portal or upon request. Enrolment commits you to the full term, regardless of attendance.
A2. Enrolment and Billing Logic
- Termly Enrolment: Contour operates on a term-based enrolment model. Enrolments cannot be cancelled partway through a term.
- Joining Partway: If you join partway through a term, you will be invoiced for the remaining weeks of that term only.
- Final Two Weeks Rule: If you enrol within the final two weeks of a term, you will be charged for those remaining weeks plus the full upcoming term.
- Continuity: Enrolment and associated payments automatically continue into the next term unless written notice is received by the deadline.
A3. Final Term Policy (Term 4)
- Full Term Billing: If you enrol in a Year 12 subject in Term 4 at any time, you will be billed for the entirety of the term.
- Reasoning: This reflects that all high-value resources (recordings, workbooks, SACs, workshops, and exam materials) are made available from the beginning of the program. This ensures fairness to students who enrolled earlier.
A4. 2026 Fee Schedule & Grandfather Pricing
We offer "Grandfather Pricing" to loyal families who have been with us through 2025.
Grandfather Pricing Eligibility Rules:
- Continuous Enrolment: Families must have at least one student fully enrolled through Term 4 2025 (up to Week 47 for 3/4 subjects or Week 50 for other subjects).
- Scope: Applies to all siblings in the same family (residing at the same address) but not to cousins or friends.
- Payment Deadline: Enrolments for 2026 must be completed and paid in full by the invoice due date or 11:59pm, 31 December 2025 (whichever is earlier) to receive grandfather pricing.
- Lapse: If you withdraw and re-enrol after the deadline, or if payment is made after the deadline, the Standard 2026 Fees will apply automatically.
4. Schedule B – Contour MedPrep
Applies to students enrolled in UCAT and Medical Entry programs.
B1. Non-Affiliation Disclaimer
IMPORTANT: Contour MedPrep is a private educational service. We are NOT affiliated, associated, authorised, endorsed by, or in any way officially connected with:
- The UCAT Consortium (UKCAT/UCAT ANZ);
- ACER (Australian Council for Educational Research); or
- Any University or Medical School.
All practice questions and program materials are created independently by our Team Members to simulate the exam experience.
B2. Enrolment and Billing Logic
- Termly Enrolment: Contour operates on a term-based enrolment model. Enrolments cannot be cancelled partway through a term.
- Joining Partway: If you join partway through a term, you will be invoiced for the remaining weeks of that term only.
- Final Two Weeks Rule: If you enrol within the final two weeks of a term, you will be charged for those remaining weeks plus the full upcoming term.
- Continuity: Enrolment and associated payments automatically continue into the next term unless written notice is received by the deadline.
B3. Final Term Policy (Term 3)
- Term 3 Lock-in: Term 3 is the final term for Year 12 students or current-year UCAT applicants.
- Full Billing: Students who enrol during Term 3 are billed for the entire Term 3, as all course materials and digital resources are made available from Week 1.
B4. Fee Policy
All fees are billed per term in advance. No Grandfather Pricing applies to MedPrep.
MedPrep Weekly Fees:
- Year 10 / Year 11: $120 / week
- Year 12 / Grad: $135 / week
- Year 10 / Year 11 (UK): £39 / week
- Year 12 / Year 13 / Grad (UK): £45 / week
Medify Access Pricing:
- Year 10/11 Version: $576 (two-year access) / £268 (UK)
- Year 12/Grad Version: $360 (one-year access) / £168 (UK)
Mock Examinations:
Any Mock Examination accessed without a full enrolment will incur a weekly fee of $135 per mock attended.
5. Schedule C – Contour TestPrep
Applies to students enrolled in TestPrep programs (e.g., Selective Entry, Scholarship).
C1. Non-Affiliation Disclaimer
Contour TestPrep is independent of any official testing body (e.g., ACER, Edutest). Our materials are developed internally to assist students in their preparation.
C2. Enrolment and Billing Logic
- Termly Enrolment: Contour operates on a term-based enrolment model. Enrolments cannot be cancelled partway through a term.
- Joining Partway: If you join partway through a term, you will be invoiced for the remaining weeks of that term only.
- Final Two Weeks Rule: If you enrol within the final two weeks of a term, you will be charged for those remaining weeks plus the full upcoming term.
- Continuity: Enrolment and associated payments automatically continue into the next term unless written notice is received by the deadline.
C3. Final Term Policy (Mastery Program)
- Mastery Term: This policy applies to the Mastery Program Term (the final pre-exam block).
- Full Billing: Students who enrol during this term are billed for the entire Mastery Program Term, as all resources are released from Week 1.
C4. Fee Policy
All fees are billed per term in advance. No Grandfather Pricing applies to TestPrep.
TestPrep Weekly Fees:
- Foundation Maths, English, Writing: $80 / week per subject
- Core Maths, English, Writing: $80 / week per subject
- Mastery Maths, English, Writing: $80 / week per subject
6. Schedule D – Payments (Mandatory)
D1. BECS Direct Debit Request (DDR) Service Agreement
Required for all Direct Debit arrangements.
- Authorisation: By nominating a bank account for payment, you authorise Stripe Payments Australia Pty Ltd (User ID: 507156) to debit funds from your account for fees due to Contour.
- Notice: We will give you at least 7 days' notice in writing of any changes to the terms of this drawing arrangement.
- Your Obligations: It is your responsibility to ensure sufficient cleared funds are available in your account on the due date.
- Dishonour Fees: If a drawing is returned unpaid, your financial institution may charge you a fee. We may also charge a $15 administration fee for failed payments.
- Disputes: If you believe a debit has been made in error, please contact billing@contoureducation.com.au immediately.
